WHAT DOES REVOCATION MEAN? HERE ARE SOME TIPS ....

So, I've been getting a few calls and emails lately asking me what revocation means.

Here are some of my reflections.


The legal process is fraught with legal jargon.

The work 'revoke' used in legal terms means simply to cancel.

The cancellation, or revocation should be made in writing.


Now, just because something is revoked does not mean that it no longer exists altogether.

There is often a provision replacing that which is revoked.


Let me show you what I mean.


We had the Western Australian Proof of Vaccination Direction signed by the Police Commissioner Chris Dawson on the 26th of January 2022 - Australia Day.


Here it is:

14 pages into the document ... you can see the date the document was signed, and the person who signed it - therefore the authorisation and the source of authority:


Now, legal documents, or legislation itself is usually effective immediately from the time of singing, unless stated otherwise.


So, the above Direction was relevant from the date of signing.


When we look on the Western Australian Government Website, this is what we find:



Here is a copy of the Proof of Vaccination (No 2) (Revocation) Direction:


Now, does this mean the Direction no longer exists? No.


It simply means that there is a second version, and the first version is no longer valid, or to be adhered to.


So, in order for us to know the difference between the old and the new versions, we require full access to each version - to be able to decipher the changes specific to the document.


I have personally called the Department and requested previous versions of similar Directions in the past, and I have been denied access to prior versions.


The problem with this, is that this violates due process and the rules of transparency.


As citizens, we have the right to be a part of the political and even legal processes under a Constitutional Democracy.


We have every right to be consulted, make submissions and recommendations, for our position to be heard, considered and represented politically, and to be applied.


Of course, these matters have currently been compromised, due to several factors.


Now, as Human Rights Advocates and Lobbyists, my challenge to you is:


Call the relevant Minister's office and ask for VERSION ONE of the Directions - do your own due diligence and investigative work, and call out the Government and specific politicians directly on their violations of due process and lack of transparency.
